PUBLIC OFFER AGREEMENT FOR THE PROVISION OF SERVICES
This Agreement is entered into between Individual Entrepreneur (FOP) Yaryna Kushchenko (hereinafter referred to as the Service Provider) on the one hand, and any person ordering services (hereinafter referred to as the Customer) on the other hand.
Together referred to as the Parties, and individually as a Party.
This Public Offer Agreement (hereinafter referred to as the Agreement) is addressed to an unlimited number of persons and constitutes an official public offer by the Service Provider to enter into an agreement for the provision of services.
By ordering and paying for the Services of the Service Provider, the Customer accepts the terms of this Agreement.
1. TERMS AND DEFINITIONS
1.1 Public Offer Agreement — a legal agreement regulating the relationship between the Service Provider and Customers regarding the provision of services and purchase of products presented on the website:
1.2 Moment of conclusion of the Agreement — the moment when the Customer creates a booking, purchases a certificate for the Service Provider’s services, or purchases products from the Service Provider.
1.3 Services — one or several services provided by the Service Provider and listed in the relevant section of the website:
1.4 Customer — any legally capable individual, legal entity, or entrepreneur who visits the website https://www.kustceramics.com/ and accepts this Agreement.
2. GENERAL PROVISIONS
2.1 This Agreement has legal force in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine and is equivalent to a contract signed by both Parties.
2.2 By accepting this Agreement, the Customer confirms that they have read and fully agree with all terms of this Agreement.
2.3 The Agreement is concluded by ordering services on the website https://www.kustceramics.com/ without signing a written copy and has legal force in accordance with Articles 633 and 634 of the Civil Code of Ukraine. The Customer may not propose their own terms of the Agreement.
2.4 By entering into this Agreement, the Customer automatically agrees to the full and unconditional acceptance of the provisions of this Agreement, service prices, and all annexes that are integral parts of this Agreement.
2.5 If the Customer does not agree with the terms of the Agreement, they may not conclude this Agreement or use the Services provided under it.
2.6 KUST certificates may be returned within 14 days with a receipt or payment confirmation. The refund is made to the account of the person who paid for the certificate or in cash if the certificate was purchased with cash in the studio.
Certificates may also be gifted to another person or exchanged for other workshops or products of the Service Provider.
2.7 Finished works are stored for 3 months starting from the first day of the workshop. Please complete and collect your works in time.
3. SUBJECT OF THE AGREEMENT
3.1 The Service Provider undertakes to provide the Services to the Customer under the terms of this Agreement, and the Customer undertakes to accept and pay for the ordered Services.
3.2 The Parties confirm that this Agreement is not fictitious or concluded under pressure or deception.
3.3 The Service Provider confirms that they have the right to provide services in accordance with the laws of Ukraine.
4. RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER
4.1 The Service Provider shall:

perform obligations under this Agreement within the specified terms;

provide services of proper quality;
-
inform Customers about the services and conditions of their provision on the website.
4.2 The Service Provider has the right to:

independently establish and change service prices;
-
suspend services if the Customer violates the terms of this Agreement;

modify the Agreement unilaterally by publishing changes on the website;
-
dispose of works that remain uncollected after 3 months;
-
retain the deposit or half the certificate value if the Customer cancels a workshop less than 36 hours before the scheduled time.
5. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
5.1 The Customer must:

pay for and receive the Services according to the terms of the Agreement;

familiarize themselves with the information about the Services on the website;
-
attend the booked workshop at the scheduled time;
-
notify the Service Provider at least 36 hours in advance if cancelling a booking.
5.2 The Customer has the right to:
-
place orders for Services on the website;
-
demand proper provision of Services according to the Agreement;
-
exercise other rights in accordance with Ukrainian legislation.
6. PRICE AND PAYMENT TERMS
6.1 The price of each service is indicated on the relevant page of the website.
6.2 Payments are made in the national currency of Ukraine — UAH (Ukrainian Hryvnia).
6.3 Payment may be made via:

bank card through the website payment system
6.4 Payment is considered completed when the funds are credited to the Service Provider’s account or transferred in cash.
6.5 The Customer independently pays any third-party costs required to obtain the Services (e.g., internet access).
7. SERVICE DELIVERY AND ACCEPTANCE
7.1 Service provision rules published on the website are integral parts of this Agreement.
7.2 Payment for services confirms the receipt of services by the Customer.
7.3 For legal entities, service delivery is confirmed by a Service Acceptance Act signed by the Parties.
8. REFUND AND EXCHANGE POLICY
Payments for services and certificates can be refunded within 14 days of purchase.
Refunds are processed using the same payment method used for the original transaction.

Returned certificates are deactivated and cannot be used.
Certificates purchased on the website can be used in any KUST studio location.
9. FORCE MAJEURE
The Parties are not responsible for failure to perform obligations due to force majeure circumstances, including:

natural disasters
-
fires
-
epidemics
-
war or military actions
-
strikes
-
acts of government authorities
Proof of force majeure is provided by the Chamber of Commerce and Industry of Ukraine.
10. TERM OF THE AGREEMENT
The Agreement becomes effective when a Customer creates a booking or purchases services and remains valid until all obligations are fulfilled.
11. LIABILITY AND DISPUTE RESOLUTION
Disputes shall be resolved through negotiations between the Parties.
If negotiations fail, disputes shall be resolved in accordance with Ukrainian law in court.
The Service Provider is not liable for circumstances beyond their control.
12. PRIVACY POLICY
This Privacy Policy describes how we collect, use, and protect personal information of users of the website kustceramics.com.

13. FINAL PROVISIONS
All legal relations arising from this Agreement are governed by the laws of Ukraine.
